Terms of Service
Effective August 22, 2026. Using MissedTakes — and especially creating a Picks account — means agreeing to these terms.
The service
MissedTakes publishes predictions made by public figures in sports media and grades them against what actually happened, under a published methodology. Members may additionally record agree/disagree stances (“picks”) on published, unsettled claims and receive scores computed by the same methodology. The service is free; nothing is staked, wagered, or won — leaderboard placement, where offered, is the only outcome.
Eligibility
The service is offered from the United States and directed to U.S. residents. You must be 16 or older; creating an account includes an attestation of age. One account per person.
Accounts and conduct
A display name must not impersonate any person — including the pundits this site covers — and must not be offensive or misleading. We may reject or remove a display name that violates this; your account and private record are unaffected by a name removal.
Picks are accepted only while a claim is unsettled and are frozen when it settles; we record when you first picked and when you last changed your mind. Attempting to manipulate scoring — multiple accounts, automated picking, exploiting grading errors — may lead to score invalidation, feature restriction, or account termination.
Scores
Scores are computed by the published methodology and always shown with their sample sizes. They are commentary on picks, not statements about anyone’s skill, and may be recomputed when grades are corrected under our corrections process. Nothing about your score is shown publicly without your explicit opt-in. Members’ picks never alter a pundit’s record.
Editorial content
Claims, grades, and pundit records are our editorial commentary on public figures’ public statements, governed by the methodology and corrections pages. We summarize and attribute; we do not republish articles or transcripts.
The legal positions, plainly
Your content license to us is narrow: non-exclusive, for operating the service, ending when you delete your account except for de-identified aggregates. Our liability is capped at the greater of $100 or what you paid us in the last 12 months — currently $0, because the service is free. These terms are governed by Texas law in Texas courts. There is no arbitration clause, no class-action waiver, and no clause making you indemnify us — omissions we chose on purpose.
The service is provided as-is; we may change or discontinue features. Material changes to these terms get 14 days’ notice; continued use after the effective date is acceptance.
